The March 2014 Supreme Court Judgment lowered the threshold at which care arrangements may amount to a deprivation of liberty and therefore require authorisation either through DoLS arrangements or by an application to the Court of Protection.
This course will help you understand recent changes to the Deprivation of Liberty Safeguards (DoLS) and the need to demonstrate that care arrangements are lawful and correctly authorised.
It will enable staff to continue to follow the original intentions of the Mental Capacity Act (MCA) and the Human Rights Act: that people with diminished ability to make decisions should participate as fully as possible, be able to make important choices where able and that substituted decision making should be both person-centred and fully accountable.
